Competition Terms and Conditions of Use: Madikwe Safari Lodge

  1. Unless expressly stated otherwise these terms and conditions will apply to all competitions offered by the Parktown North Ratepayers’ and Residents’ Association (PNRA).   In the event of conflict thereof with rules applicable to any specific competition, the specific competition’s rules will prevail.

  2. The prize for this competition, being the 2017 Madikwe Safari Lodge competition, is an accommodation voucher which will be valid until the 1st December 2017.

  3. In respect of the 2017 Madikwe Safari Lodge competition, prizes not claimed by 1 December 2017 will be forfeited.

  4. In respect of the 2017 Madikwe Safari Lodge competition, a winner is not permitted to transfer or sell his/her accommodation prize to a third party.

  5. All Parktown North residents who are signed subscribers to the full PNRA Security Scheme (i.e. both armed response and public space vehicular patrolling) are eligible, and are deemed, to be entrants to the competition.

  6. Unless expressly stated otherwise, only one entry per competition per signed subscriber to said full PNRA Security Scheme contract is allowed.

  7. The following are excluded from eligibility as a competition entrant:
    7.1  A director, partner, employee or agent of, or consultant to the PNRA, or any sponsor of a competition prize;
    7.2 Any other person who directly or indirectly controls or is controlled by the sponsor; and/or
    7.3 A supplier of goods and services in connection with the competition.

  8. No cash alternative is available to any prize unless expressly stated otherwise.

  9. The closing date for any competition will be as stated.

  10. The judges’ decision is final and no correspondence relating to said decision will be entered into.

  11. All entrants’ information will be protected in accordance with our Privacy Policy.

  12. By entering any PNRA competitions, an entrant agrees to receive future correspondence from the PNRA.

  13. An option to ‘opt out’ will be available to said entrant on receipt of any PNRA newsletters.

  14. The PNRA reserves the right to cancel any competition at any time, and without notice.

  15. Multiple winners may be required, by the PNRA, to submit to an appropriate strategy to resolve a tie, or inconclusive result, in order to enable a single winner to be identified.

  16. The PNRA, at its sole discretion, may re-assign a competition prize to another entrant deserving to be nominated as winner of the competition if the PNRA is unable, after having used its best efforts, to contact a competition winner within 7 days of said winner being identified. Entrants are requested please to ensure that their correct contact details are provided to the PNRA.

  17. of any and/or all entrant(s) implicated therein and/or favoured thereby.At its sole discretion, the PNRA is entitled to respond to any deviation from the rules, and/or attempt to manipulate the outcome of the competition, by disqualification

  18. For the purpose of promoting the PNRA and/or Parktown North and/or a scheme or project relating thereto, winners of PNRA competitions may be required, for publicity purposes, to be photographed or to participate in a radio or television broadcast. No fees will be payable in this regard.

  19. Prizes are non-transferable in whole or in part; prizes are offered on specific terms and conditions and can be accepted by winners thereof only on said terms and conditions; failing which a winner of a prize will forfeit the prize which will be re-assigned to another entrant deserving to be nominated as winner of the competition.

  20. Where a competition prize includes accommodation at a destination, and travelling to and from the destination is not specifically included in the prize description, then winners of the prize must make their own way to the destination.  Neither the PNRA nor any sponsor of the competition assumes any responsibility for any transport costs.

  21. Entrants acknowledge that in consideration for the prize offered to winners by, or at the behest of, the PNRA or a sponsor of the competition, information relating to the winning entry/entries may be released, performed or displayed to the public by the PNRA and/or any person connected with the promotion and authorised by the PNRA to do so. Such information may include personal information relating to the winner and limited to the winner’s name and place of origin.

  22. Entrants agree that the PNRA is the owner of all right, title and interest in all entries, including the entire copyright, whether now existing or howsoever, arising in the future, including all worldwide rights to promote, reproduce for commercial use or otherwise, edit, advertise and publicise, produce, record and reproduce by any art medium or method whether now known or later developed (‘Exploitation Rights’) to be exercised in our sole discretion throughout the world for the full term of copyright and other rights in the entries and all extensions thereof including for the avoidance of doubt the right to register any design rights and/or trademarks. Entrants undertake to do all things necessary, including the execution of any requisite documentation to transfer the Exploitation Rights to us, as and when requested by us.

  23. Further, the entrant irrevocably and unconditionally waives all moral rights to which they may now or at any time in the future be entitled pursuant to any copyright law and under any similar law in force from time to time anywhere in the world in respect of all works referred to herein.

  24. By entering into a PNRA competition, an entrant is deemed to have read and understood these rules.

  25. In the case of a competition by means of a draw, the draw will take place within 3 weeks of the closing date of the competition, unless otherwise stipulated.

  26. The PNRA, any sponsor of any competition prize, affiliates of the PNRA or of any said sponsor, any competition partner/s thereof and/or any of their respective shareholders, and/or anyone associated via the PNRA or said sponsor with the competition   shall not be liable in any way whatsoever for any loss, damage, injury or costs, howsoever arising, which might be suffered as a result of an entrant’s participation in a competition.

  27. Should any person who is automatically eligible as an entrant to any competition, wish NOT to participate in the competition, said person must advise the PNRA thereof, in writing by e-mail addressed to residents@parktownnorth.org

  28. The Madikwe Safari Lodge accommodation voucher INCLUDES a double room for two people sharing for a period of  2 nights at Madikwe Safari Lodge (subject to availability), and during said period, all meals, game drive refreshments and two safari drives per day.

  29. The Madikwe Safari Lodge accommodation voucher EXCLUDES park fees, beverages, specialist activities not included in the standard daily rate, any items of a personal nature, and transport to and from the Lodge.

  30. All extras are payable by cash or credit card on departure from the Lodge.

  31. The Madikwe Safari Lodge accommodation voucher does not imply or confer any credit facilities in favour of the winner.

  32. The Madikwe Safari Lodge accommodation voucher is not exchangeable for cash or any other service provided by the Lodge.

  33. The Madikwe Safari Lodge accommodation voucher MUST be presented by the winner on booking and arrival at Madikwe Safari Lodge.

  34. Any extension to the period sponsored by the voucher will be payable by the winner-guest at the standard rate charged by the Madikwe Safari Lodge.

  35. The Madikwe Safari Lodge accommodation voucher may not be offered towards payment for any “package” or “special” on offer by the Lodge at any time.

  36. Madikwe Safari Lodge reserves the right to cancel or withdraw any voucher if, in their opinion, it is subject to misuse.

  37. Please note that the Madikwe Safari Lodge accommodation voucher CANNOT be used on weekends, school holidays, Easter and Christmas holidays.

  38. The Final Winner’s Draw for the competition will take place on 31 July 2017 in Parktown North at 6.30pm.

  39. After the Final Winner’s Draw, the winner will be announced in the Rosebank Killarney Gazette, and in an email to PNRA members.

  40. The PNRA has compiled these Rules and Conditions for the PNRA Competitions in good faith and with reference to the relevant provisions of section 36 of the South African Consumer Protection Act 2008 with which the PNRA believes said Rules and Conditions apply.  The PNRA represents the Parktown North community and hence invites any member of the PNRA who bona fide believes that anything in said Rules and Conditions is illegal, to notify the PNRA thereof by e-mail address to chair@parktownnorth.org, with a comprehensive motivation for believing same.
